Love this idea of a separate program that looks at the individually holistically to offer financial empowerment not just for debts due to the municipality but also assisting with other debt

These consequences are soooo much more about systemic racism and school to prison pipeline than just license suspension. The only way we will change this is to make it a problem in the white community. When law enforcement sits outside bars that whites frequent, FM and RM roads after 7 PM where whites enter and leave urban areas, and patrolling whites who live in such areas, then and only then will we see a difference to this type legislation.

Is there a balance with judges discretion? I am worried about unconscious bias judges hold as individuals and I think broad guidelines from the state can be helpful in formalizing a process of engagement around ability to pay

I would also note that the vast majority of people with fines and costs never actually see a judge, just a clerk, so judicial discretion only gets you so much

@Mital I think limiting the punitive responses available to judges and law enforcement could cabin discretion and help, like ending driver’s license suspensions for debt and ending custodial arrests for Class C offenses

@Emily totally agree and NLC is ending a TA initiative on addressing fines and fees. One of the cities actually had their clerk who deals with payment plans go through the financial empowerment program they were offering to residents so she would have a first person understanding to the program and its benefits. It was something we learned when we did debt reduction with cities around water utility debt
